TERMS AND CONDITIONS

 

 

  1. Contracting Parties:

 

  • LESSORS:

VIP Limuzin Kft. (Registered office: 1239, Budapest, Fakopács utca 5 / a, tax number: 26230362-1-43, company registration number: 01-09-309077)

HBSZ Termelő Kft. (Registered office: 1239, Budapest, Fakopács utca 5 / a, tax number: 12422414-1-43, company registration number: 01-09-933689)

  • Hereinafter referred to as the Lessors, provide and lease their own and their partners’ vehicles as a means of transporting passengers by bus for a fee, subject to the conditions listed below. VIP Limuzin Kft. & HBSZ Termelő Kft. are entitled to sell not only their own services, but also the services they purchased, in an unchanged form, as an intermediary service.
  • The LESSEE can be a natural or legal person, however, the lease agreement can only be concluded by a responsible adult natural person.

 

  1. Order, cancellation:

  • Lessee shall contact the Lessors via the Contact Form on the website, by telephone or via e-mail (info@viplimuzin.hu).
  • After getting in touch, Lessee requests a quote in writing by e-mail or fills in the quote request form on the website.
  • Finalization of the order always happens in writing by e-mail when Lessors receive all the pieces of information required for the booking. The reservation is considered final if the Lessee has provided all the necessary information in full, and sent it to the Lessors to complete the reservation. The Lessors will inform the Lessee by e-mail about the necessary information.
  • Lessors will send a written confirmation of the booking to the Lessee.
  • Payment for the full service fee must be made to the limousine driver before boarding at the latest.
  • The Lessee has the opportunity to cancel the reservation free of charge one week before the chosen and reserved date. In case of cancellation within one week (7 days) before the booked date, the Lessors are entitled to invoice the full fee for the service, and the Lessee is obliged to reimburse the full fee for the service.
  • In case of cancellation, the Lessors will not refund the fee / fees paid in advance.
  • The Lessee is obliged to notify the Lessors in writing of the fact of the cancellation of the limousine rental by sending a letter to the official email address of the Lessors (info@viplimuzin.hu). Rental cancellation request shall be deemed to have been delivered to the Lessors if the Lessors have also sent feedback to the Lessee in the form of an e-mail acknowledging it.
  • If the Lessee does not wish to use the service in Budapest, but requests delivery, then the Lessors will charge an extra fee in addition to the prices indicated on the website (www.viplimuzin.hu). In all cases, the Lessors will inform the Lessee by e-mail about the exact fee before the booking is finalized.
  • Lessors commit to the required limousine when ordering. Of course, every effort will be made to ensure that the Lessee receives the limousine they require during the service. If it is not possible to provide the ordered limousine, the same category of limousine will be provided to the Lessee. If a limousine cannot be provided in the same category, the replacement vehicle may only be of a higher category and the Lessors shall provide it to the Lessee at the price of the category originally confirmed in the order.

 

  1. Duration of Rental Period:

  • In each case, the lease agreement is for a pre-determined period of time.
  • The minimum basic unit for the duration of the lease is half an hour, ie 30 minutes.
  • In all cases, the rental starts at the time submitted in advance when ordering. If the Lessee or the passengers have to wait due to a delay or other reason, it will be at the expense of the duration of the rental.
  • If, for any reason, the trip is completed before the end of the rental period, the Landlords will not refund the rental or other fees.
  • Extension of the rental period:

o It is not always possible to extend the duration of the limousine rental during the trip.

o The extension of the limousine rental can only be extended at the request of the driver with the consent of the owners.

o In the case of an extension of a limousine rental, the basic unit of the minimum rental time is still a minimum of half an hour, ie 30 minutes.

o In the event of an extension of the limousine rental, the rental fee for the extended period will be determined on the basis of the fees currently in force.

 

 

  1. Airport Transfer Services:

  • Travel time:

Airport transfer is a shuttle service between the Airport and the accommodation Hotel. We transport our passengers in the most optimal way, regardless of the time of day and traffic. The travel time varies accordingly between 30 and 60 minutes.

  • Passenger liability:

In case of providing incorrect, untrue data (eg incorrect date, time, address, telephone number, number and size of packages) we cannot guarantee the fulfillment of the service and the Lessee is responsible.

The Lessee is obliged to notify the Lessors immediately after becoming aware of any changes related to the trip. Landlords shall not be liable for any damages incurred in connection with the failure to notify.

  • Waiting / Flight Delay

Lessors cannot be held responsible for flight delays and cancellations. Lessors shall not be liable for large delays or cancellations due to the airline’s fault (eg late refueling, machine failure, etc.) or weather (fog, snow, ice, wind).

The waiting time at the airport varies depending on which of the service packages provided by VIP Limousine you choose:

o Basic package (free)

For scheduled landings, we can guarantee the transport of passengers for a delay of no more than 30 minutes. So after the original landing time, the ordered limousine is available at the airport for a maximum of 60 minutes. The passenger signals to the driver when he is in front of the terminal exit. The limousine will then arrive at the terminal in a few minutes.

o Extra package (+ 35 EUR)

After the original landing time, the limousine is available for passengers at the airport for 90 minutes. The passenger signals to the driver when he is in front of the terminal exit. The limousine will then arrive at the terminal in a few minutes.

o VIP package (+ 80 EUR)

  • Package pick-up / Package size:

After landing, passengers have 30 minutes to collect their luggage and get to the exit of the terminal.

Passengers are obliged to inform the Lessors in advance about the number and exact dimensions of the packages.

The luggage compartment of the limousines can only carry a maximum of 1 piece of standard-sized luggage (length + width + height) according to the number of passengers to be carried. For extra-sized luggage, extra luggage and the transport of non-standard luggage (eg bicycles, dogs, prams, etc.) we have to provide a separate car, which costs + 30 EUR.

If the passengers do not indicate the quantity of the extra packages or give incorrect dimensions when placing the order, the Lessors may not be able to deliver the packages due to lack of space. The resulting damages and inconveniences are the responsibility of the Lessee!

 

 

  1. Terms of booking:

  • Proof of identity with address (ID card, license or passport number).
  • Tenant assures the landlord that he will take part in the trip of his own free will.
  • The Lessee assures the Lessor that when submitting the order it communicates real data and information to the service provider, the Lessors.
  • By providing the data required for the rental, the Lessee agrees that the Lessors will record the Lessee’s personal data (in order to comply with the legal requirements) and keep it for another 15 days after the completion of the trip in order to identify and investigate any complaints. The personal data obtained by the Lessors will be handled in accordance with the provisions of the Data Protection Act and will be permanently deleted from their database 15 days after the performance of the problem-free service. Lessors do not register, store or archive the concluded leases.
  • Lessee is obliged to provide all necessary information to Lessors. Lessors may otherwise refuse to provide the service.
  • Lessee is obliged to declare in advance about the persons participating in the trip in the form of a passenger list. The full name of the passengers (surname + first name) must be indicated in the passenger list. This is a legal requirement for bus companies in Hungary!

 

  1. Content of the rental fee:

  • Limousine rental includes:

o Free disembarkation within Budapest

o Provide a suitably qualified driver to drive the limousine

o Fuel cost

o Compulsory motor third party liability insurance

o Regularly maintained, serviced, clean limousine

o Seasonal vehicle preparation (tire, air conditioning, heating)

o Glasses, bar equipment in the passenger compartment

o Music playback and connection options (flash drive, bluetooth, AUX, etc.)

  • Limousine rental does not include:

o Parking and ferry fees

o Highway usage fees

o Entry permits

o Drinks

o Decoration

o Or any other costs that are not part of the basic service

 

 

  1. Payment, invoicing:

  • Unless the parties decide otherwise, the full fee for the service must be paid to the driver provided by the Lessors before the start of the trip.
  • The indicated prices and the invoice always include value added tax (VAT).
  • The prices of the service specified in the offer are in all cases the gross prices to be paid and are given in euros (EUR).
  • Lessors are entitled to provide the service provided to the Lessee at a higher price than previously fixed due to the effects of various economic changes (especially changes in operating costs, inflation). In these cases, the Lessors are obliged to notify the Lessee in writing before the fulfillment of the service.
  • If the Lessee wishes to request a VAT invoice for the service, he/she is obliged to notify the Lessors when placing the order.
  • An invoice related complaint can be filed within 3 working days of receiving the invoice.
  • The Lessee is obliged to provide the Lessors with the invoice issuance data in advance, before the cash flow, otherwise the invoice will be issued to the name and address of the Lessee, ie a natural person.

 

  1. Payment, invoicing:

  • Discounts and promotions applied by Lessors are valid for a specified period of time, unless otherwise specified, in all cases until revoked.
  • Discounts cannot be combined unless the Lessors allow it.
  • Lessors offer the opportunity to purchase discounted trips (last minute trips), coupons and gift vouchers under certain conditions. With discounted coupons and vouchers for pre-determined periods, limousine rental can be paid if the place, time and method of use meet the conditions specified in the description and all details have been agreed by email.
  • Discount Cards: Lessors also periodically provide discount cards to their customers / passengers. Discount cards are valid until revoked and cannot be combined with other discounts if used.
  • The Lessors shall not be liable in cases where the purchased coupon or voucher has not been used by the Lessee during the period of use.

 

  1. Lessee’s responsibility:

  • The Lessee takes full responsibility for the behavior of him/herself and his/her passengers / fellow passengers during the trip.
  • In the limousine, like in any other places, the general rules of etiquette must be followed! Eg: We don’t put our feet on the seat, on the bar counter! We don’t stick chewing gums anywhere! We do not throw rubbish away and we pay attention to cleanliness! Etc., etc .
  • The devices in the limousine must be used by the passengers for their intended purpose and stored in their original place after use (for example: glasses, bottles, other devices).
  • Passengers must not open or close the doors when the vehicle is moving or standing. This task can only be performed by the driver.
  • The Lessee assumes full financial guarantee and liability for any material damage and any violations committed by the passengers traveling in the limousine during the rental period. If the amount of damage caused is so great that the vehicle is unable to continue operating at an impeccable standard, then the compensation will be supplemented by the resulting lost revenue!
  • Only drinks provided by the Lessors may be consumed in the limousines. It is FORBIDDEN to bring any other beverages into the limousine unless the Lessors have given special permission to do so.
  • The limousine arrives at the site with a tidy, clean cabin, it must be left in the same tidy condition.
  • In case of leaving the limousine in a messy, dirty condition due to non-normal use, the Lessors’ employee (driver) will charge the Lessee HUF 10,000 for external washing and HUF 20,000 for internal cleaning! If the removal of the dirt cannot be done with basic cleaning tools, ie there are additional costs (upholstery cleaning, plastic care, polishing, etc.), the full cost must be paid by the Lessee!
  • In case of breaking 1 glass, the Lessee will be charged HUF 2,000, in case of breaking a whiskey bottle HUF 30,000.
  • In the event of damage to the Display, the Lessee should pay HUF 200,000, and in the event of loss or damage to the remote control of the multimedia device, HUF 50,000.
  • In case of vomiting in a limousine, the renter will be charged an extra cleaning fee of HUF 100,000, as the car will become unsuitable for work for the rest of the day!
  • The Lessee acknowledges that FOOD CONSUMPTION and SMOKING are strictly FORBIDDEN in the limousines provided by the Lessors!
  • If the Lessee or his / her passengers consume food or smoke in the limousine despite the ban, the Lessors or their employee (driver) is entitled to charge a surcharge of HUF 50,000.
  • It is FORBIDDEN TO STAND ONTO SEATS AND TRAVEL STANDING in limousines!
  • In limousines with sunroofs, it is STRICTLY FORBIDDEN AND DANGEROUS TO STAND, sit or travel with the sunroof open, while driving! Furthermore, it is FORBIDDEN to bend over the windows of a limousine in traffic, to sit on the window frames, to throw anything out or to spit!
  • The Lessee acknowledges that the Lessors’ employee (driver) has the right to refuse to fulfill the service or to refuse boarding of certain passengers if he / she considers that their condition does not meet the desired requirements: drunk, under the influence of a mind-altering substance, his / her clothing is dirty / messy, his / her state of health is unsuitable, his / her illness makes him / her unfit for travel.
  • The Lessors’ employee (driver) has the right to immediately terminate the trip or rental if the passengers’ behavior is inappropriate or any of the rules listed above are violated.
  • If the Lessee gives unprofessional instructions to the driver, the driver must warn the renter and refuse the request! If, despite the warning, the Lessee continues to give an instruction which the driver is unable or unwilling to comply with because it would violate the rules of the road or impede traffic, the Lessors may withdraw from the contract immediately, so the driver may terminate the journey immediately.
  • The driver must refuse to comply with any instruction the execution of which would violate a law or official decision or endanger the person or property of others.
  • The Lessee agrees to fully inform all persons and prospective passengers participating in the trip before the start of the trip, and to provide information on the rules read and accepted here!
  • Lessee, Lessee’s passengers are obliged to inspect the passenger compartment of the limousine completely before leaving! Lessors are not responsible for items that are supposed to be forgotten or are forgotten in the limousines!

 

  1. VIS MAJOR:

  • Situations influenced by external factors that cannot be prepared for in advance can still hinder the fulfillment of the original rental conditions. In these cases, the Lessors cannot and do not assume any financial responsibility and the tenant cannot claim damages. Of course, the service can be performed at a later agreed new date if the Lessee still needs it.
  • Unexpected technical error that occurs without any signs despite careful maintenance. Thus, a defective or incapacitated car / limousine will be unable to perform the service at the pre-booked date. Examples of such failures are: a puncture, a faulty generator, a punctured water pipe, a punctured air spring, etc.
  • Accident. Unfortunately, it is can prevent the fulfillment of the limousine rental. There are two possible situations:

o Due to an accident, the limousine gets stuck, is unable to proceed, unable to return due to its size, and therefore unable to approach the rental location at the time booked in advance.

o The rented limousine itself is involved in an accident.

  • Extreme weather conditions may make it impossible for Lessors to fulfill the service. Unfortunately, heavy rain, heavy snowfall, and freezing rain can also be obstacles. Lessors will inform the Lessee in these cases, but can only offer a new date, as they have no influence on the weather.
  • The specified location cannot be reached by limousine. Due to their size, limousines are not able to cope with all kinds of terrain or narrow streets. So it is the Lessee’s responsibility to order a limousine at such a location and the car is unable to approach the site for this reason. Not only should the starting point itself be chosen carefully, but the factors of the journey to it should also be taken into account. So the Lessee cannot make a complaint, a claim for damages, if he/she ordered the vehicle to a place inaccessible to a limousine.

o These vehicles need a large roundabout, so they cannot turn into narrow streets, but an irregularly parked car can also cause issues and hinder parking.

o In the case of a high speed bump or a sudden difference in level, the limousines cannot move on either, because they get stuck on these obstacles.

o Furthermore, steep ascents and slopes are also enemies of limousines.

o If an entry permit is required for any of the specified locations, the Lessee is obliged to inform the Lessors in advance!

o Due to their size, limousines cannot enter to certain areas due to weight restrictions!

  • Government prohibition measures (curfew, ban on groupings, etc.)
  • Furthermore, all cases and situations the outcome and course of which cannot be influenced by the operating companies (VIP Limuzin Kft. / HBSZ Termelő Kft.).

 

  1. Photos and sound recording:

  • Simultaneously with the ordering of the limousine or other service mediated by the Lessors, the Lessee accepts that during the service audio, pictures and video recordings of the passengers may be made public on the service provider’s website (www.viplimuzin.hu), social media platforms and our media partners’ platforms and may appear on the websites of our cooperating partners. Images and audio material taken during the trip may be used by Lessors and their partners for marketing purposes. If the Lessee does not consent to this, he/she must notify the Lessors in writing when finalizing the order!
  • We are unable to deliver the recorded materials to the customer(s). Any participant who appears on the recordings may not make any claims against the recorders or the operators of the companies. If you still wish to make a complaint, please notify us in writing at info@viplimuzin.hu and we will remove the requested media material(s) upon request.

 

  1. Intellectual property:

  • The Website and all content, descriptions, graphics, graphics, logos, images and videos on the Website are the exclusive property of VIP Limuzin Kft. The Website is subject to the provisions of Act LXXVI of 1999 on Copyright, is a collective work as defined in section 7 of the Act and as such is protected by copyright.
  • The contents of the Website may not be copied, recorded, reproduced, distributed, transmitted, downloaded, edited, resold or published in any form, whether analogue or digital. The use of any content of the Website in any form, whether for commercial or other purposes, is possible only with the prior written consent of VIP Limuzin Kft.
  • Any infringement of the intellectual property of VIP Limuzin Kft. (Unlawful use of trademarks, copyright infringement, etc.) will result in the infringer being held liable.

 

  1. Complaints & Disputes:

  • Lessors do not provide any guarantee or liability for the services mediated! In the event of a problem or complaint related to these services, the Lessee may not claim damages from the Lessors.
  • Lessors handle and act on any complaints that may arise in accordance with the Complaints Handling Regulations published on its website (www.viplimuzin.hu).
  • If the Lessee’s attempt to settle the complaint amicably is unsuccessful, the Lessee is entitled to apply to the conciliation body or court of the Budapest Chamber of Commerce and Industry to settle the dispute, and to the consumer protection authority if there is a suspicion of violating consumer protection legislation.

 

  1. Validity:

  • The Terms and Conditions (TC) are valid until revoked, failure to know them does not release the Lessee from liability!
  • By ordering any service or using the service, the Lessee must accept these TC, and his / her email address will be included in the subscription list. In this way, we can notify the customer of current changes, promotions and other important information. The request to delete from the subscription list can be requested in writing at the following email address: info@viplimuzin.hu.
  • If the Lessee does not accept these TC, he/she is not entitled to use the services provided by the Lessors.
  • Lessors are entitled to unilaterally amend these TC at any time. The effective date of the amended new TC is the day on which the amended TC is published on the website (www.viplimuzin.hu). The operators of the website are listed in these TC as Lessors and VIP Limuzin Kft. / HBSZ Termelő Kft., And the website is called “VIP Limuzin”.
  • The rules of Hungarian law apply to these TC.
